These terms govern your use of the CoastMate app and website (the “service”), provided by OceanComm Labs LLC (“we”). By using the service you agree to them. If you do not agree, do not use it.
CoastMate is an informational and planning aid for recreational boaters. It is not a navigation system of record, a weather service, a legal or medical advisor, or an emergency service. Information may be incomplete, delayed or wrong, and AI-generated answers can contain mistakes.
The person in command of the vessel is solely responsible for its safe operation and for everyone aboard. You are responsible for the accuracy of the information you enter, for keeping your device charged and connected, and for making sure the shore contacts you add agree to receive messages from the service.
Keep your login private and tell us if you think it has been misused. You must be at least 13 years old to use the service, and old enough in your location to enter a binding agreement or have a parent or guardian agree for you.
Do not misuse the service: no unlawful use, interfering with or attempting to break into the service, reverse engineering except where the law allows, scraping, or using it to harass others.
Some features may require a paid subscription, sold through the Apple App Store or Google Play and subject to their terms. Prices, free trials and cancellation are handled by the store where you bought it. We will describe paid features before you buy.
You own the content you add (such as photos and trip details). You give us permission to store, process and display it as needed to run the service, including sending alerts to shore contacts you choose.
The service, including its software, design and name, belongs to OceanComm Labs LLC and its licensors. We give you a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes.
The service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, OceanComm Labs LLC and its owners, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, property, or profits, or for personal injury or death arising from boating or from your use of or inability to use the service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some places do not allow these limits, so they may not apply to you.
You can stop using the service and delete your account at any time in the app. We may suspend or end access if you break these terms or to protect the service.
We may update these terms. The new version will be posted here with a new effective date. Continuing to use the service after that means you accept them.
These terms are governed by the laws of the State in which OceanComm Labs LLC is organised, without regard to conflict-of-law rules.
